Please read this User Agreement (Agreement) carefully in order to understand your rights and obligations before you offer to sell your phone on sellyt.com. When setting up an account on sellyt.com, you must agree to the terms and conditions outlined below. sellyt.com reserves the right to amend, cancel, or alter the terms of this Agreement at our sole discretion by posting an amended Agreement on sellyt.com. Except as stated below, the amended User Agreement will be effective immediately after it is posted.
When you set up an account with sellyt.com or when you submit a sell order, you agree to these policies, terms and conditions.
Your use of sellyt.com may be terminated or suspended if you do not comply with this Agreement or our policies and procedures, or for any other reason we determine necessary, in our sole discretion, to protect the site and its users.
Ability to Sell
It is very important that you are convinced and happy that you want to deal with sellyt.com and you are well within your rights to do so.
You represent and warranty that you are not a minor and that you can form legally binding contracts under applicable law. Whether you are an individual or business, you also represent and warranty that you rightfully own or are legally authorized to sell any phones you enter into the sellyt.com system. If you do not qualify, please do not attempt to use sellyt.com.
If you are minor and have used sellyt.com, your parents or guardians cannot hold us liable for any claims that may result from your breach of this warranty
By selling on our site, you warrant that you are a resident of India and accessing sellyt.com from India
You will identify the make and model number (usually located behind the battery) of the phone you are interested in selling to sellyt.com, and you will provide information about the condition of the phone and any accessories. If sellyt.com wishes to buy the phone you have identified and described, sellyt.com will give you a Quote based on the information you have provided. THE QUOTE IS NOT A GUARANTEED PRICE. sellyt.com will pay the full amount of the Quote only if we receive you phone within 7 days of providing the Quote and sellyt.com finds that the make and model, condition, and accessories of the phone match the information provided.
You then may accept the Quote and add the phone to your Cart. You may add multiple phones to your Cart, but the total of the Quotes for a single Cart shall not exceed INR 100000.
For high value submissions or for bulk lots (5+ phones), sellyt.com staff will review the submission and provide a quote.
In all cases, sellyt.com maintains the rights to review, edit, or cancel the submission in part or in whole.
If a phone fails to meet our terms and conditions we'll propose an adjusted price by email. If you choose to decline our new offer, we are happy to return the phone. We have the final decision on all phone values. Adjusted orders will be automatically processed for payment if you do not reply to our proposed offer email within 2 days.
After receiving the packing materials from sellyt.com you will schedule the pick-up of the phone. You will then ship the phone in the secure package together with your order number, via the provided shipping method within 3 days of receiving the packing material.
Phones and gadgets must be packaged in accordance with our packaging instructions to ensure safe and successful delivery to us.
You may add basic confirmation of delivery to your shipment free of charge, but sellyt.com will not be responsible for any damages or loss during transit.
Condition of Phone
sellyt.com reserves the right to determine the model, the condition, and the accessories of each phone and make adjustments to the Quote or withdraw its offer to buy the phone entirely based on its assessment.
Each mobile phone or device sold should match the make and model in the sell order. Each phone submitted as working or flawless must meet the following non-exclusive list of conditions:
- It powers up and is able to make calls
- Turn on and off (with all buttons working)
- Screen/LCD display works and not broken or bleeding
- Display light comes on
- Keypad, scroll bars, camera work
- No water damage - a red dot beneath the battery indicates the handset has come in contact with moisture or water
- No loose or broken flip functionality
- Case and housing is complete, unbroken, with no major scratches and in acceptable condition
- No parts should be missing
- Have a fully working operating system (software)
- Fully functional
- Any additional functionality provided by the handset like camera, wi-fi, video must work.
Those phones that do not meet the above requirements will be re-priced which may bring down the Quote.
All phones must not be 'activation locked'. Phones on an overseas network or locked will not be accepted. Apple devices must delinked from any iCloud accounts.
By submitting an order through our site you warrant that the phone(s) comply with these terms.
Lost or Stolen Mobile Phones and Free and Clear Electronic Serial Number (ESN)
Selling a phone or device which you do not own may amount to a criminal offence.
sellyt.com only buys phones that have a valid and verifiable ESN or IMEI number. This means that the sticker under the battery that displays this number must be clearly visible.
It is your responsibility to ensure sellyt.com does not receive phones with ESN numbers that are associated with an account, have been reported lost or stolen, or are otherwise blocked. Every phone with an ESN is verified before resale by sellyt. If sellyt.com determines during verification that the ESN is not free and clear, you will be notified by email and given seven (7) days to clear the ESN. If you do not successfully clear the ESN within the seven (7) days, then sellyt.com will not buy the phone.
Phones associated with an account will be returned subject to the provisions of the Returns section below. Those reported lost or will attempt to deliver to the authorities or the rightful owners rather than to you, and the Quote will be withdrawn.
If we have paid you for a phone that you have sold to us and subsequently there is an issue regarding the ownership of the phone, you will immediately reimburse us. If sellyt.com is ever penalized or fined or suffers any loss or damages because a phone you offered to sell was not yours to sell, then you will reimburse sellyt.com for all costs incurred, including legal fees.
If at any point of time there are issues about ownership of a phone sold to us, you agree to co-operate with us fully with a view to resolving the issues.
We may disclose seller details to the Police or other authorised bodies (such as, but not limited to, network operators and insurance companies) for the purpose of investigating or preventing a crime. By entering into this contract you agree to us supplying data to the police or other authorised bodies for the purpose of the prevention and detection of crime, arrest and prosecution of offenders or for the recovery of stolen property.
After you correctly mention the condition of your phone, we provide a quote. Only if you are happy with the price quoted, you should chose the payment method confirm your sell order on sellyt.com. Please note that this payment option cannot be changed once the sell order is placed. The phone that you are selling should reach us within 7 days of the sell order. If sellyt.com determines that the phone that we receive from you has the same condition that you had mentioned in your sell order and t if here is no violation of any other term of this Agreement, then sellyt.com will initiate payment to you as follows:-
- If we receive your phone before 11.15 am on a bank working day:
Payment method – Bank Transfer - Instructions will be sent to our bank or on the same day
Payment method – Cheque – Your cheque will be sent by courier on the same day
- If we receive your phone after 11.15 am on a bank working day:
Payment method – Instructions will be sent to our bank on the next bank working day
Payment method – Cheque – Your cheque will be put in courier the next day
If there are events which are out of our control (e.g., the courier company has a holiday), the payment schedule will get affected accordingly.
Bank Transfer payments can only be made into the account that that has been provide by you while confirming the sell order. It will not be possible to recall or reissue bank transfer payments once they have been made. So request you to provide bank details correctly.
If the phone does not reach us within 7 days, or if the condition of the phone does not match with the information that you had provided about the phone while confirming the sell order, you will be notified by e-mail with an Adjusted Quote. We have the final decision on all phone values. If you are not happy with our new quote and intimate the same to us within two (2) business days, we will reurn your phone free of cost. If you accept the Adjusted Quote within two (2) business days after it is sent, we will make the payment to you for the adjusted quote. In case you you do not respond to the Adjusted Quote within two (2) business days, we will automatically initiate payment for the adjusted quote.
All cheques will be made payable to the customer registered with sellyt.com and sent to the address specified during registration. If you require a check to be reissued, a 250 INR fee will be deducted from the amount paid.
The payment made through bank transfer or cheque by sellyt.com is the full and final payment for the phone and completes our transaction. sellyt.com owns the phone in full after payment has been sent. sellyt.com is not a collateral loan broker and will not hold your phone for you to buy back.
Prices offered on our website are subject to change at any time without notice.
If sellyt.com provides an Adjusted Quote to you and you no longer wish to sell the phone to sellyt.com, sellyt.com will return the phone to you free of charge.
If sellyt.com determines that it does not wish to buy the phone because of its condition, it will notify you and will return the phone to you free of charge. Or if you do not wish to take it back, we can just recycle it for you at our cost.
It is your responsibility to discontinue service for a phone before sending the phone to sellyt.com. sellyt.com is not responsible for any airtime charges accrued prior to, during, or after any transaction. Should any airtime charges be accrued, it is your responsibility to pay any accrued charges.
Also, request you to cancel any contract that you may have with any telephone services provider that may be attached to your phone. We will not bear any claims or costs before, or after, receipt of your phone, because of non-cancellation of such contracts or arising from any other circumstances whatsoever.
Please remove your SIM card before sending us your phone. In case the SIM card is mis-used or charges are levied after you have sent the phone, it would be your responsibility to pay those charges and also be accountable for the mis-use.
Evidence of Illegal Activity
Sellyt.com may report to the proper authorities and, if required, surrender to the proper authorities any phone that sellyt.com receives that has stored on it illegal data or images.
It is your responsibility to remove any and all personal information from all phone memory and removable memory including but not limited to, phonebook entries, personal codes, e-mail addresses, personal addresses, IM addresses, photos, and downloaded files. sellyt.com is not responsible for any damages to you or anyone else that may result from stored information on a phone you sold to us. It should be noted that by selling your phone to us, you agree to release us from all and any claims, losses or damages with respect to the phone, any data stored or contained therein or on any media used in conjunction with the phone (whether in the form of personal details, SMS, photos, games, songs or other data ("Data")). We accept no responsibility in relation to the security, protection, confidentiality or use of such data and it is your responsibility to ensure that such data is removed from the phone before sending it to us.
You hereby indemnify and hold harmless sellyt.com with respect to any and all liabilities, claims, causes of action, injuries, costs, attorney's fees, losses, and/or damages of any kind or character directly or indirectly arising out of matters relating in any way to this Agreement and your transactions with sellyt.com.
Suspension and Termination
We may issue a warning or temporarily suspend, indefinitely suspend or terminate your account or any of your sales if (i) you breach this User Agreement, (ii) you provide false information or we are unable to verify or authenticate any information you provide to us, (iii) you infringe the intellectual property rights of others, or (iv) you engage in any act of collusion or price manipulation.
You agree to comply with all applicable laws, statutes, ordinances, regulations, and payment of applicable taxes regarding your use of our service and your sale of any phones.
This User Agreement and your setting up of an account in no way constitute or give rise to a partnership joint venture, or other relationship between the parties.
Events Outside Of Our Control
We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under a contract that is caused by events outside our reasonable control or due to our compliance with any applicable laws or regulations.
Choice of Law and Venue
This Agreement will be governed by the law of India. Any disputes arising out of the Agreement will be brought in the courts of Mumbai.
